Updated: Why You May Want to Avoid LELO's New Products: IDA & TARA

The LELO IDA and LELO TARA were to be launched with new rotating vibrators that can be worn during intercourse, but there was a hitch. 

The makers of We-Vibe products, Standard Innovations, Corp. have indicated that these products violate their patents just as the LELO Tiani, Tiani 2 and Noa were found to be through a decision made by the U.S. International Trade Commission this summer. 

Danny Osadca, the CEO of Standard Innovations, Corp. was quoted in XBiz.com through an article dated 9-15-13 as saying  “...anyone who attempts to carry Lelo’s new couples massagers would do so at its peril and in violation of the ITC Orders. This could result in penalties from the US government of up to $100,000 a day, as well as the potential of other legal action.”

Both companies have said in public statements that they stand by those that sell their products, even in articles regarding these lawsuits, yet Standard Innovations, Corp. has already sued retailers and distributors for carrying some of the LELO products and LELO sent cease and desist letters to many retailers and demanded a count of any of the We-Vibe 3 products sold, thus, making it appear they are preparing legal action against resellers as well.

Bottom line is that they are both going after the very resellers of their products that have helped them to create their success instead of working this out between themselves, which is what most companies do. Many retailers are left wondering what to do, having lost trust with both companies and feeling that the risk of being sued just to offer either of their products is not worth taking.

It would seem more conducive to both companies to refrain from legally threatening resellers in any form as it causes damage to both their reputations with both retailers and distributors. One would hope that the two companies would realize that they have left those that sell any of their products in a very uncomfortable position. In many cases, resellers are quite put off to say the least by being legally threatened for simply selling sex toys that should have been cleared legally to sell prior to being put on the market.

It also makes it difficult for resellers to explain to customers why they cannot provide a product that the customer desires; not just because they are worried about being sued, but because customers are also legally vulnerable to such lawsuits. Thus, ethical retailers have a responsibility to their customers to inform them of something that may also put them in jeopardy.


It seems that this battle between We-Vibe and LELO is far from over with LELO also taking legal steps against Standard Innovations, Corp. for the charging technology in their We-Vibe 3 products making the only products like this that are currently not involved in these legal battles the We-Vibe 2 and the about to be released We-Vibe 4 (which is using a different remote control technology). This is why some retailers are now calling this the Hatfield & McCoy sex toy war.

inductive charging patent disputes
 
Standard Innovation® and LELO® have reached an agreement to settle all outstanding lawsuits related to U.S. Patent No. 7,931,605, Canadian Patent Nos. 2,591,401 and 2,684,004, the couples vibrator patents, and US patent No. 7,749,178, the inductively chargeable massager patent. The settlement includes a cross-licensing agreement that allows both companies to respectfully license and use each other’s relevant intellectual property.
 
The agreement grants LELO a license to Standard Innovation’s couples vibrator patent for use in products such as LELO Tiani, Tiani 2, Tiani 3, Tiani 24k, Noa and Intimina Kalia, and grants Standard Innovation a license to LELO’s inductively chargeable massager patent.
 
The settlement agreement is between Standard Innovation and LELO only. It does not apply to any other manufactures. Standard Innovation will continue to pursue legal actions against those parties who attempt to market and sell products that infringe its intellectual property rights. Standard Innovation holds patents on its couples vibrator products in Australia, Brazil, Canada, China, the European Union, Hong Kong, Japan, Mexico, and the United States, and has patents pending in Australia, Brazil, Canada, China, the European Union, Hong Kong, India, Russia and the United States. Standard Innovation is represented by Osler, Hoskin & Harcourt LLP. Osha Liang LLP, and Mayer Brown LLP.

1.     Does the settlement affect We-Vibe products with inductive charging? The agreement grants Standard Innovation a license to LELO’s inductively chargeable massager patent for use in our products such as We-Vibe II Plus, We-Vibe 3, We-Vibe 4, We-Vibe 4 Plus and We-Vibe Classic.
2.     Can I now distribute/sell LELO couples products? LELO has a license under Standard Innovation’s patents to sell the LELO Tiani, Tiani 2, Tiani 3, Tiani 24k, Noa and Intimina Kalia.
3.     Can I distribute and/or sell other couples products that are intended to be worn during intercourse? No, the license is granted to LELO only. Standard Innovation will continue to take all steps to enforce its valuable intellectual property rights.

5.     What lawsuits have been settled? All US and Canadian lawsuits related to Standard Innovation's couples vibrator patents (U.S. Patent No. 7,931,605, Canadian Patent Nos. 2,591,401 and 2,684,004) and LELO’s inductively chargeable massager patent (US patent No. 7,749,178) have been settled.
6.     Will Standard Innovation license its patents to other companies? We are not considering additional licensing proposals.
